Duskroom: terms of use
Effective date: [EFFECTIVE DATE — TO BE SET AT LAUNCH]
These terms apply to your use of the Duskroom app ("the app"), provided by TheAppNest ("we"). By using the app you agree to them. If you don't agree, please don't use the app.
1. The app
Duskroom plays and mixes ambient sounds, with timers for focus, sleep and relaxation. There is a free version with ads and limits, and a paid Premium version.
Not a medical device. The app is meant for relaxation and focus. It does not diagnose, treat or prevent any condition. If you have trouble sleeping or concentrating, please talk to a health professional. Keep the volume at a comfortable level, especially with headphones.
2. Your licence
We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial use.
You may not:
- copy, extract or redistribute the app's sounds, artwork or fonts outside the app;
- reverse engineer the app, except where the law allows it;
- use the app to break any law.
Third-party components are listed under Settings › About › Licences, with their own licences.
3. Premium, subscriptions and payments
All purchases are made through Google Play, under the Google Play Terms of Service. Prices are shown in the app before you buy, as provided by Google Play for your country.
- Yearly and Monthly subscriptions renew automatically at the end of each period until you cancel. Cancel any time in the Google Play app: Menu › Payments & subscriptions › Subscriptions. You keep Premium until the end of the period you've paid for.
- Free trial: where offered, the monthly plan starts with a free trial. If you don't cancel before the trial ends, the subscription starts and you're charged.
- Lifetime is a one-time purchase. It isn't a subscription and never renews.
- Refunds are handled by Google Play under its refund policies. This doesn't affect any rights you have under consumer law.
- Restore purchases: Premium is tied to your Google account. Use Restore purchases in the app after reinstalling or on a new phone.
4. Ads and rewarded unlocks
The free version shows ads (see the Privacy policy). Watching a rewarded ad, which only starts when you choose to, unlocks one Premium sound for 24 hours. Ad availability isn't guaranteed. Unlocks expire after 24 hours and are not a purchase.
5. Changes and availability
We may update the app to:
- add, change or remove features or sounds;
- fix problems;
- comply with the law or Google Play policies.
We'll try to keep the app available, but can't promise it will always work without interruption on every device.
6. Liability
The app is provided "as is", to the extent the law allows. Nothing in these terms excludes, restricts or modifies any right or remedy you have under consumer protection law, including the Australian Consumer Law, that can't lawfully be excluded.
Subject to that, we aren't liable for indirect or consequential loss arising from your use of the app. Where our liability can be limited, it is limited to re-supplying the service or the amount you paid for it.
7. Ending
You can stop using the app at any time by uninstalling it. Uninstalling does not cancel a subscription; cancel it in Google Play. We may end your licence if you break these terms.
8. Governing law
These terms are governed by the laws of Victoria, Australia.
9. Changes to these terms
If these terms change, we'll update the effective date above and publish the new version at the same address. Continuing to use the app after a change means you accept it.
